Commercial

When booking a Commercial Cleaning Service with CE Cleaning Company Sydney PTY LTD ABN 47 651 553 463 (more info here) known as CE Cleaning Company Sydney  (“CE Cleaning Company Sydney.”) you (the “Client”) agree to the terms and conditions as listed below.

  1. Cleaning Services

1.1) a minimum of 4 hours per visit is required for once off cleaning which is charged at an hourly rate, there is no minimum hours for regular cleaning 1.2) CE Cleaning Company Sydney. agrees to provide the Service to the Client at an address specified by the Client (the “Premises”);   1.3) the Service will be for such cleaning duties as agreed with the client at the time of booking;   1.4) CE Cleaning Company Sydney. will provide one or more cleaners to attend the Premises to provide the Service at a time and date mutually agreed between CE Cleaning Company Sydney. and the Client;   1.5) CE Cleaning Company Sydney will do it’s utmost to provide the Service faithfully, diligently and in a timely and professional manner.

  1. Additions and Amendments 

2.1) any changes to the Service to be provided must be agreed by CE Cleaning Company Sydney. prior to the Service Time by phone or email;   2.2) if the Client requires any additional services or variations at the time the Service is being performed, the Client must first contact CE Cleaning Company Sydney by email at least 48hrs before the scheduled clean or at least 24hrs prior via phone. The Cleaner is not authorised to agree to any changes to the Service provided if this condition is not met.

  1. Client Representations and Warranties

The Client represents and warrants that:   3.1) Client will provide a safe working environment at the Premises for the Cleaner(s) to perform the Service;   3.2) the Cleaner(s) will have unencumbered and unobstructed access to those areas of the Premises requiring the Service;   3.3) Client will provide the Cleaner(s) with access to all services and utilities (including hot and cold water, electricity, and rubbish bins) as required by the Cleaner(s) to provide the Service;   3.4) all cleaning equipment and materials provided by the Client are safe, have not been tampered with and are in full working order;   3.5) Client will advise CE Cleaning Company Sydney. prior to the commencement of the Service of any hazards, slippery surfaces, risks or dangers, at the Premises;   3.6) Client is authorised to use the Premises and obtain the provision of Service;   3.7) if the Client requires the Cleaner to clean behind or under any heavy items (e.g. appliances, bookshelf etc), it is the clients responsibility to move those items prior to the commencement of the Service   3.8) It is the clients responsibility to secure or remove any fragile, delicate, breakable or valuable items, including cash, jewellery, works of art, antiques, or items of sentimental value prior to the commencement of the Service and CE Cleaning Company Sydney will not be held responsible for missing or broken items

  1. Health and Safety Risks

4.1) the cleaner(s) is entitled to undertake a Job Safety Analysis before the commencement of any work to assess the health and safety risk at the Premises;   4.2) the cleaner(s) may, either before or during the provision of the Service not provide or cease the provision of the Service where carrying out the Service presents, in the absolute discretion of the cleaner, a risk to health and safety;   4.3) in such case, the cleaner(s) will immediately report such a risk to health and safety and the non-provision of the Service to CE Cleaning Company Sydney, who will discuss this with the Client at the earliest time possible.

  1. No Engagement of Cleaners 

5.1) the Client acknowledges that CE Cleaning Company Sydney. invests significant resources in recruiting, selecting and training its Cleaners. Unless CE Cleaning Company Sydney. gives prior written permission, the Client must not, directly or indirectly, engage, employ or contract with any Cleaner(s) to provide any cleaning services to the Client or any associate of the client for any period during which services are provided by CE Cleaning Company Sydney. or for a period within 12 months after the conclusion of any Service;   5.2) the Client acknowledges that CE Cleaning Company Sydney. may suffer loss and damage, including, without limitation consequential loss, as a result of a breach of this clause by the Client.

  1. Job Quotations

6.1) the total rate payable by the Client is calculated on the total number of hours worked by the cleaner(s) and/or by the quoted contracted time allocated at time of Contract signing;   6.2) any price quoted by CE Cleaning Company Sydney. is an estimate based on CE Cleaning Company Sydney’s experience and based on information provided by the Client;   6.3)subject to this clause, quotes are valid for a period of 30 days from the date of the quote;   6.4) if at the commencement or during the course of providing the Service, it is apparent that the Service Fee for the Service will exceed the quote estimate provided by CE Cleaning Company Sydney, CE Cleaning Company Sydney. will provide the Client with the option to pay an increased fee to complete the Service, or pay the quoted amount without the Service being completed.

  1. Bookings

7.1) the Client can request a job quotation from CE Cleaning Company Sydney. for a Service either in person, by phone, email or through the CE Cleaning Company Sydney. website;   7.2) CE Cleaning Company Sydney. will visit the Premises, if/when possible, and discuss the Client’s unique cleaning needs, before presenting it with a quotation for the required Service, usually by email;    7.3) when the Client accepted the quotation provided by CE Cleaning Company Sydney, a booking will be made either in person, by telephone or email;   iv.) CE Cleaning Company Sydney. reserves the right not to accept a booking for any reason.

  1. Payment Terms

8.1) CE Cleaning Company Sydney. will provide a Tax invoice to the Client at the end of each month, including increased fees agreed with the Client as set out in clause 6(6.4);   8.2) the Client agrees to pay CE Cleaning Company Sydney. by the end of the following month by direct debit or bank transfer;   8.3) the Client agrees that if CE Cleaning Company Sydney. has not received payment in full for the Service within one calendar month of the original Tax invoice date, then a late payment fee of 10% will be charged for every month unless alternative arrangements can be made with CE Cleaning Company Sydney;   8.4) failure of Service Fee payment may result in legal action against the Client;   8.5) in such case, the Client agrees to indemnify CE Cleaning Company Sydney. for all legal costs (on a solicitor and own client or full indemnity basis, whichever is greater) and other expenses incurred by CE Cleaning Company Sydney. in connection with a demand, action, or other proceeding (including mediation, out of court settlement or any action taken for recovery of debt from the Client) arising out of a breach of these terms including the failure by the Client to pay an amount by the due date;   8.6) CE Cleaning Company Sydney. reserves the right to report any non-payment to a debt collection agency at its sole discretion.

  1. GST

9.1) unless specified otherwise, all prices and quotations are expressed to be GST exclusive amounts;   9.2) if GST is payable in respect of anything supplied to the Client under this Agreement, then the amount which the Client is obliged to pay for that supply (Original Amount) will (subject to the receipt of a valid tax invoice) be grossed up so that it results in, CE Cleaning Company Sydney. retaining the Original Amount plus any GST amount.

  1. Non-appearance 

10.1) If the Cleaner(s) fail to attend the Premises within 1 hour of the Service Time, without prior arrangements or cancellation and the requested Service is not provided, CE Cleaning Company Sydney. will at their discretion either:

  1. a) not charge the Client for the missed Service; or   
  2. b) reschedule the Service at another time mutually agreed between the Client and CE Cleaning Company Sydney.
  3. Complaints

11.1) if the Client is dissatisfied for any reason with the Service provided, it must inform CE Cleaning Company Sydney. within 24 hours of completion of the Service;   11.2) CE Cleaning Company Sydney. strives to achieve 100% client satisfaction and will endeavour to resolve the problem quickly and efficiently;   11.3) CE Cleaning Company Sydney. may, at its discretion, offer the Client either of the following:   

  1. a)  re-supply of the Service without charge;   
  2. b)  such other remedy as deemed appropriate by CE Cleaning Company Sydney.
  3. Exclusions and Limitations

12.1) the only conditions and warranties which are binding on CE Cleaning Company Sydney. in respect of the state, quality or condition of the Service provided by CE Cleaning Company Sydney. to Clients are those imposed and required to be binding by statute (including the Trade Practices Act 1974);   12.2) to the extent permitted by statute, the liability, if any, of CE Cleaning Company Sydney. is, at CE Cleaning Company Sydney. option, limited to and completely discharged by the resupply of the Service. CE Cleaning Company Sydney. is not responsible for:

  1. a)  not completing or providing the Service as a result of a breach of a warranty by the Client in clause 3 (including a failure by the Client to provide proper materials, cleaning equipment, utility services, a safe working environment or unencumbered access to the Premises); or
  2. b)  any damages caused by defective cleaning materials or cleaning equipment provided by the Client;
  3. c)  not completing or providing the Service as a result of the Cleaner not proceeding for health and safety reasons under clause 4;
  4. d)  any loss or damage incurred by the Client or any third party as a result of the effects of a force majeure, being any event beyond the reasonable control of CE Cleaning Company Sydney.;
  5. e)  not completing or providing the Service due to an act or omission of the Client or any other person at the Premises during provision of the Service;
  6. f)  existing dirt, wear, damage or stains that cannot be completely cleaned or removed;
  7. g)  any wear or discolouring of fabric or surfaces becoming more visible once dirt has been removed;
  8. h)  any loss incurred as a result of any breakage or damage to goods, items of value (including antiques, items of sentimental value) or the Premises; or
  9. i)  the cost of any key replacement or locksmith fees.

12.3) except as provided in this clause, all conditions and warranties implied by law in respect of the state, quality or condition of the Service which may apart from this clause be binding on CE Cleaning Company Sydney. are excluded;   12.4) the Client acknowledges that the results of any services provided may vary depending on a number of factors (including materials used, equipment provided, time elapsed since Premises was last cleaned, and nature of cleaning required), and that CE Cleaning Company Sydney. gives no guarantee as to the actual results of the Service;   12.5) except to the extent provided in this clause, CE Cleaning Company Sydney. has no liability (including liability in negligence) to any person for any loss or damage, consequential or otherwise, suffered or incurred by that person in relation to the products or services provided by CE Cleaning Company Sydney. (including any loss caused by, or resulting directly or indirectly from, any failure, defect or deficiency or any kind of or in the products used or services provided by CE Cleaning Company Sydney.)

  1. Indemnity

The Client indemnifies CE Cleaning Company Sydney. against:

13.1) all losses or liabilities arising directly or indirectly as a result of the provision of the Service including all losses or liabilities caused as a result of a breach of the warranties of the Client set out in clause 3; and   13.2) all legal costs (on a solicitor and own client or full indemnity basis, whichever is greater) and other expenses incurred by CE Cleaning Company Sydney. in connection with a demand, action, arbitration or other proceeding (including mediation, compromise, out of court settlement or appeal and including any action taken for the recovery of a debt from the Client).

  1. Accidents, Breakage, Damage & Theft

14.1) the Client must inform CE Cleaning Company Sydney. of any incident where an accident, breakage, damage to property or theft has occurred due to any act of the Cleaner within 24 hours of completion of the Service; 14.2) to the extent permitted by law, the Client is not entitled to claim any loss for any incident if the incident is not reported to CE Cleaning Company Sydney. within 24 hours of completion of the Service;   14.3) to the extent permitted by law, damage or loss to the following items are specifically excluded from the liability of CE Cleaning Company Sydney. under these terms and conditions: cash, jewellery, art, antiques, and items of sentimental value.

  1. Cancellation Fees

15.1) the Client must provide CE Cleaning Company Sydney. with at least 24 hours’ notice prior to the Service Time, if they wish to suspend, postpone or cancel the Service for any reason;   15.2) in the event that such notice has been given, CE Cleaning Company Sydney. will endeavour to reschedule the Service if required;   15.3) in the event that the Client does not provide 24 hour notice prior to the commencement of the Service, the Client agrees to pay a cancellation fee equivalent to 2 hours cleaning (inclusive of GST) for administrative costs and loss.

  1. Fee for Non-access to Premises

In the event that the Client does not provide unencumbered access the Premises for CE Cleaning Company Sydney. or its Cleaner(s) to provide the Service, the Client agrees to pay a cancellation fee equivalent to 4 hours cleaning (inclusive of GST) for administrative and travel costs.

  1. Termination

17.1) this Agreement may be terminated by the Client by providing at least 1 weeks’ notice prior to the Service Time;   17.2) subject to clause 17(17.3), CE Cleaning Company Sydney. may terminate this Agreement by providing the Client with at least 1 weeks’ notice prior to the Service Time;   17.3) CE Cleaning Company Sydney. may terminate this Agreement with immediate effect if the Client is in breach of this Agreement, and in the opinion of CE Cleaning Company Sydney, acting reasonably, that breach is incapable of remedy.

  1. Privacy Policy

18.1) the Client acknowledges that, subject to the provisions of the Privacy Act 2012 (Commonwealth), any information provided by the Client may be used by CE Cleaning Company Sydney. for the purpose of providing the Service. CE Cleaning Company Sydney. agrees not to share any information provided by the Client with any third party not directly involved in the provision of the Service (unless required to do so by law);   18.2) the Client agrees to CE Cleaning Company Sydney. communicating with them electronically and/or via other means in order to provide the Service or for reasons related to the provision of the Service;   18.3) CE Cleaning Company Sydney. will take all reasonable precautions to protect personal information provided by the Client from loss, misuse, unauthorised access or disclosure, alteration or destruction.

  1. Changes to this Agreement

19.1) CE Cleaning Company Sydney. reserves the right to update or modify these terms and conditions at any time without prior notice. CE Cleaning Company Sydney. agrees to share an updated agreement with the Client via email. Each updated agreement will take effect 24 hours after it has been shared with all existing Clients of CE Cleaning Company Sydney;   19.2) the Client agrees that any use of the Service following any such change, whether as a single job or as part of a regular cleaning schedule, constitutes their agreement to follow and be bound by the terms and conditions as changed.

  1. Law & Jurisdiction

The Client and CE Cleaning Company Sydney. acknowledge and accept that this Agreement shall be construed and interpreted in accordance with the laws of Western Australia and both agree to submit to the exclusive jurisdiction of the courts of Western Australia in the event of any dispute.

  1. Severability

The Client agrees that if any term or provision is held invalid, void or unenforceable, then that provision will be considered severable and the remaining terms and provisions shall continue to be binding.

Residential Cleaning Service

When booking a Residential Cleaning Service with CE Cleaning Company Sydney  (“CE Cleaning Company Sydney.”) you (the “Client”) agree to the terms and conditions as listed below.

  1. Cleaning Services

1.1) a minimum of 2 hours per visit is required for CE Cleaning Company Sydney’s Residential Cleaning Services (the “Service”);   1.2) CE Cleaning Company Sydney. agrees to provide the Service to the Client at an address specified by the Client (the “Premises”);   1.3) the Service will be for such cleaning duties as agreed with the client at the time of booking;   1.4) CE Cleaning Company Sydney. will provide one or more cleaners to attend the Premises to provide the Service at a time and date mutually agreed between CE Cleaning Company Sydney. and the Client;   1.5) CE Cleaning Company Sydney. endeavours to provide the Service faithfully, diligently and in a timely and professional manner.

  1. Additions and Amendments 

2.1) any changes to the Service to be provided must be agreed by CE Cleaning Company Sydney. prior to the Service Time by phone or email;   2.2) if the Client requires any additional services or variations at the time the Service is being performed, the Client must first contact CE Cleaning Company Sydney. by phone. The Cleaner is not authorised to agree to any changes to the Service provided.

  1. Client Representations and Warranties

The Client represents and warrants that:   3.1) it will provide a safe working environment at the Premises for the Cleaner(s) to perform the Service;   3.2) the Cleaner(s) will have unencumbered and unobstructed access to those areas of the Premises requiring the Service;   3.3) it will provide the Cleaner(s) with access to all services and utilities (including hot and cold water, electricity, and rubbish bins) as required by the Cleaner(s) to provide the Service;   3.4) all cleaning equipment and materials provided by the Client are safe, have not been tampered with and are in full working order;   3.5) it will advise CE Cleaning Company Sydney. prior to the commencement of the Service of any hazards, slippery surfaces, risks or dangers, at the Premises;   3.6) it is authorised to use the Premises and obtain the provision of Service;   3.7) if the Client requires the Cleaner to clean behind or under any heavy items (e.g. a fridge, bookshelf, or other furniture), it will move those items prior to the commencement of the Service; and   3.8) it will secure or remove any fragile, delicate, breakable or valuable items, including cash, jewellery, works of art, antiques, or items of sentimental value prior to the commencement of the Service.

  1. Health and Safety Risks

4.1) the cleaner(s) is entitled to undertake a Job Safety Analysis (JSA) before the commencement of any work to assess the health and safety risk at the Premises;   4.2) the cleaner(s) may, either before or during the provision of the Service not provide or cease the provision of the Service where carrying out the Service presents, in the absolute discretion of the cleaner, a risk to health and safety;   4.3) in such case, the cleaner(s) will immediately report such a risk to health and safety and the non-provision of the Service to CE Cleaning Company Sydney, who will discuss this with the Client at the earliest time possible.

  1. No Engagement of Cleaners

  1. Bookings

7.1) the Client can request a job quotation from CE Cleaning Company Sydney. for a Service either in person, by phone, email or through the CE Cleaning Company Sydney. website;   7.2) when the Client accepted the quotation provided by CE Cleaning Company Sydney, a booking will be made either in person, by telephone or email;   7.3) CE Cleaning Company Sydney. reserves the right not to accept a booking for any reason.

  1. Payment Terms

8.1) CE Cleaning Company Sydney. will provide a Tax invoice to the Client after the Service for the amount of the Service Fee, including increased fees agreed with the Client as set out in clause 6(6.4);   8.2) the Client can either settle payment by means of internet transfer or providing CE Cleaning Company Sydney. with their valid credit or debit card details, and authorises CE Cleaning Company Sydney. to debit their card with an amount equal to any Service and/or cancellation fees that may apply under this Agreement, including a surcharge of 1.5%;   8.3) the Client, making use of the second payment option set out in clause 8(8.2), also authorises CE Cleaning Company Sydney. to debit the card provided by the Client with any cancellation fees or charges due set out in clause 15 and 16, including the surcharge of 1.5%. CE Cleaning Company Sydney. will inform the Client of such payments before their account will be debited with the appropriate amount;   8.4) in the event that the Client’s card provided is declined during a debit made by CE Cleaning Company Sydney, CE Cleaning Company Sydney. will use reasonable endeavours to contact the Client to report the unsuccessful transaction. If CE Cleaning Company Sydney. cannot contact the Client before the next Service Time, CE Cleaning Company Sydney. may cancel further Services until the outstanding payment has been resolved;   8.5) the Client agrees to pay CE Cleaning Company Sydney. within 7 days after the Tax invoice date;   8.6) the Client agrees that if CE Cleaning Company Sydney. has not received payment in full for the Service within one calendar month of the original Tax invoice date, then a late payment fee of 10% will be charged for every month unless alternative arrangements can be made with CE Cleaning Company Sydney;   8.7) failure of Service Fee payment may result in legal action against the Client;   8.8) in such case, the Client agrees to indemnify CE Cleaning Company Sydney. for all legal costs (on a solicitor and own client or full indemnity basis, whichever is greater) and other expenses incurred by CE Cleaning Company Sydney. in connection with a demand, action, or other proceeding (including mediation, out of court settlement or any action taken for recovery of debt from the Client) arising out of a breach of these terms including the failure by the Client to pay an amount by the due date;   8.9) CE Cleaning Company Sydney. reserves the right to report any non-payment to a debt collection agency at its sole discretion, and in doing so this may affect your credit rating and or ability to seek rental properties in the future.

  1. Direct Debit Request

9.1) by signing the Direct Debit Request Form (the “Direct Debit Request”) the client authorises CE Cleaning Company Sydney. to make periodic debits as indicated on the Direct Debit Request;   9.2) the debit amount will be debited from the Client’s account according to the terms and conditions of the Client’s agreement with CE Cleaning Company Sydney;   9.3) it is the Client’s responsibility to ensure that there are sufficient cleared funds in the nominated account by the due date to enable the direct debit to be honoured on the debit date;   9.4) the Client will be responsible for any fees and/or charges applied by the Client’s financial institution for each unsuccessful debit attempt together with any collection fees, including but not limited to any solicitor fees and/or collection agent fee as may be incurred by CE Cleaning Company Sydney;   9.5) CE Cleaning Company Sydney. will keep the information about the Client’s nominated account private and confidential unless this information is required to investigate a claim made relating to an alleged incorrect or wrongful debit, to be referred to a debt collection agency for the purposes of debt collection, or as otherwise required or permitted by law;   9.6) CE Cleaning Company Sydney. should be contacted if the Client wish to alter or defer any of the debit arrangements.

  1. GST

10.1) unless specified otherwise, all prices and quotations are expressed to be GST exclusive amounts;   10.2) if GST is payable in respect of anything supplied to the Client under this Agreement, then the amount which the Client is obliged to pay for that supply (Original Amount) will (subject to the receipt of a valid tax invoice) be grossed up so that it results in, CE Cleaning Company Sydney. retaining the Original Amount plus any GST amount.

11.) Non-appearance 

11.1) if the Cleaner(s) fail to attend the Premises within 1 hour of the Service Time, without prior arrangements or cancellation and the requested Service is not provided, CE Cleaning Company Sydney. will at their discretion either:

  1. a) reschedule the Service at another day and time, before the next Service Time, mutually agreed between the Client, CE Cleaning Company Sydney. and the Client’s allocated Cleaner;
  2. b)  reschedule the Service at another day and time, before the next Service Time, mutually agreed between the Client and CE Cleaning Company Sydney., making use of a substiute Cleaner if the regular allocated Cleaner is not available and a relief Cleaner can be identified for the required day and time; or
  3. c)  wait for the next Service Time to receive regular Services as usual from the Client’s allocated Cleaner.
  4. Complaints

12.1) if the Client is dissatisfied for any reason with the Service provided, it must inform CE Cleaning Company Sydney. within 24 hours of completion of the Service;   12.2) CE Cleaning Company Sydney. strives to achieve 100% client satisfaction and will endeavour to resolve the problem quickly and efficiently;   12.3) CE Cleaning Company Sydney. may, at its discretion, offer the Client either of the following:   

  1. a)  re-supply of the Service without charge;   
  2. b)  such other remedy as deemed appropriate by CE Cleaning Company Sydney.
  3. Exclusions and Limitations

  1. a)  not completing or providing the Service as a result of a breach of a warranty by the Client in clause 3 (including a failure by the Client to provide proper materials, cleaning equipment, utility services, a safe working environment or unencumbered access to the Premises); or
  2. b)  any damages caused by defective cleaning materials or cleaning equipment provided by the Client;
  3. c)  not completing or providing the Service as a result of the Cleaner not proceeding for health and safety reasons under clause 4;
  4. d)  any loss or damage incurred by the Client or any third party as a result of the effects of a force majeure, being any event beyond the reasonable control of CE Cleaning Company Sydney.;
  5. e)  not completing or providing the Service due to an act or omission of the Client or any other person at the Premises during provision of the Service;
  6. f)  existing dirt, wear, damage or stains that cannot be completely cleaned or removed;
  7. g)  any wear or discolouring of fabric or surfaces becoming more visible once dirt has been removed;
  8. h)  any loss incurred as a result of any breakage or damage to goods, items of value (including antiques, items of sentimental value) or the Premises; or
  9. i)  the cost of any key replacement or locksmith fees.

13.3) except as provided in this clause, all conditions and warranties implied by law in respect of the state, quality or condition of the Service which may apart from this clause be binding on CE Cleaning Company Sydney. are excluded;   13.4) the Client acknowledges that the results of any services provided may vary depending on a number of factors (including materials used, equipment provided, time elapsed since Premises was last cleaned, and nature of cleaning required), and that CE Cleaning Company Sydney. gives no guarantee as to the actual results of the Service;   13.5) except to the extent provided in this clause, CE Cleaning Company Sydney. has no liability (including liability in negligence) to any person for any loss or damage, consequential or otherwise, suffered or incurred by that person in relation to the products or services provided by CE Cleaning Company Sydney. (including any loss caused by, or resulting directly or indirectly from, any failure, defect or deficiency or any kind of or in the products used or services provided by CE Cleaning Company Sydney.)

  1. Indemnity

The Client indemnifies CE Cleaning Company Sydney. against:

14.1) all losses or liabilities arising directly or indirectly as a result of the provision of the Service including all losses or liabilities caused as a result of a breach of the warranties of the Client set out in clause 3; and   14.2) all legal costs (on a solicitor and own client or full indemnity basis, whichever is greater) and other expenses incurred by CE Cleaning Company Sydney. in connection with a demand, action, arbitration or other proceeding (including mediation, compromise, out of court settlement or appeal and including any action taken for the recovery of a debt from the Client).

  1. Accidents, Breakage, Damage & Theft

15.1) the Client must inform CE Cleaning Company Sydney. of any incident where an accident, breakage, damage to property or theft has occurred due to any act of the Cleaner within 24 hours of completion of the Service; 15.2) to the extent permitted by law, the Client is not entitled to claim any loss for any incident if the incident is not reported to CE Cleaning Company Sydney. within 24 hours of completion of the Service;   14.3) to the extent permitted by law, damage or loss to the following items are specifically excluded from the liability of CE Cleaning Company Sydney. under these terms and conditions: cash, jewellery, art, antiques, and items of sentimental value.

  1. Cancellation Fees

16.1) the Client must provide CE Cleaning Company Sydney. with at least 24 hours’ notice prior to the Service Time, if they wish to suspend, postpone or cancel the Service for any reason;   16.2) in the event that such notice has been given, CE Cleaning Company Sydney. will endeavour to reschedule the Service if required;   16.3) in the event that the Client does not provide 24 hour notice prior to the commencement of the Service, the Client agrees to pay a cancellation fee equivalent to 2 hours cleaning (inclusive of GST) for administrative costs and loss.

  1. Fee for Non-access to Premises

In the event that the Client does not provide unencumbered access the Premises for CE Cleaning Company Sydney. or its Cleaner(s) to provide the Service, the Client agrees to pay a cancellation fee equivalent to 2 hours cleaning (inclusive of GST) for administrative and travel costs.

  1. Termination

18.1) this Agreement may be terminated by the Client by providing at least 1 weeks’ notice prior to the Service Time;   18.2) subject to clause 18(18.3), CE Cleaning Company Sydney. may terminate this Agreement by providing the Client with at least 1 weeks’ notice prior to the Service Time;   18.3) CE Cleaning Company Sydney. may terminate this Agreement with immediate effect if the Client is in breach of this Agreement, and in the opinion of CE Cleaning Company Sydney, acting reasonably, that breach is incapable of remedy.

  1. Privacy Policy

19.1) the Client acknowledges that, subject to the provisions of the Privacy Act 2012 (Commonwealth), any information provided by the Client may be used by CE Cleaning Company Sydney. for the purpose of providing the Service. CE Cleaning Company Sydney. agrees not to share any information provided by the Client with any third party not directly involved in the provision of the Service (unless required to do so by law);   19.2) the Client agrees to CE Cleaning Company Sydney. communicating with them electronically and/or via other means in order to provide the Service or for reasons related to the provision of the Service;   19.3) CE Cleaning Company Sydney. will take all reasonable precautions to protect personal information provided by the Client from loss, misuse, unauthorised access or disclosure, alteration or destruction.

  1. Changes to this Agreement

20.1) CE Cleaning Company Sydney. reserves the right to update or modify these terms and conditions at any time without prior notice. CE Cleaning Company Sydney. agrees to share an updated agreement with the Client via email. Each updated agreement will take effect 24 hours after it has been shared with all existing Clients of CE Cleaning Company Sydney;   20.2) the Client agrees that any use of the Service following any such change, whether as a single job or as part of a regular cleaning schedule, constitutes their agreement to follow and be bound by the terms and conditions as changed.

  1. Law & Jurisdiction

The Client and CE Cleaning Company Sydney. acknowledge and accept that this Agreement shall be construed and interpreted in accordance with the laws of Western Australia and both agree to submit to the exclusive jurisdiction of the courts of Western Australia in the event of any dispute.

  1. Severability

The Client agrees that if any term or provision is held invalid, void or unenforceable, then that provision will be considered severable and the remaining terms and provisions shall continue to be binding.
